The AEPD (Spanish Agency for Personal Data Protection) could fine Google by five, infringements against the Spanish LOPD (Personal Data Protection Act) in the Mediterranean country. The quantity of the fine could reach €601,012.10 by each of the two serious and three very serious infringements.
The Spanish Administrative Authority considers that there is enough evidence to prove that Google captured data without the explicit consent of their owners through the vehicles used for taking the photos of the streets of different Spanish cities in order to include the images in the implementation of the Street View applicantion.
The AEPD also has verified that once collected, Google transferred the data to the US, without complying with the guarantees, including the explicit consent of the holder, which is required by the law to this respect. Google carried out the capture of those personal data (location data of the network Wi-Fi, e-mail addresses, passwords, real name of the holder of the network, Wi-Fi, keys for access to social networks, etc. ), some of them specially protected under Spanish law, and the users didn’t klnow what was happening. The search engine would also have collected e-mails, texts, etc.
The administrative procedure has been suspended, while it is still pending the juditial decission on the same topic in the judicial proceedings before the Magistrate No. 45 in Madrid to which the AEPD has forwarded its report on this matter. The AEPD (Spanish Autority in charge of personal data protection) is part itself in this juditial procedure where this Autority is legitimated to carry out evidence activities and do allegations.
